Research Summary :

This research describes the problematical in regulating Alternative Dispute Resolutions in The Financial Services Sector in Indonesia. The establishment of Alternative Dispute Resolutions in The Financial Services Sector in Indonesia isn’t explicitly mentioned in the Financial Services Authority Act and its amendments. Additionally, the regulations  by the Financial Services Authority Governing Alternative Dispute Resolutions Institutions in the Financial Services Sector are formulated without including the Arbitration Law and Alternative Dispute Resolutions Institutions in their considerations. Lastly, there is inconsistency concerning the new term “lembaga Alternatif penyelesaian Sengketa Sektor keuangan” (Alternative Dispute Resolutions Institutions in the Financial Services Sector) used in the Law on Strengthening and Developing the Financial Services Sector, which differs from the term used in previous regulations related to the Financial Service Authority.
