Research Summary :

This research explores the trigerring events of non-international armed conflicts recorded in Scopus-indexed scientific journal. It is a normative study that discusses the application of international humanitarian law norms in events that can be categorized as non-international armed conflicts. It also addresses armed violence within the country, such as the armed violence perpetrated by Gerakan Aceh Merdeka (GAM) in Aceh and The Armed Criminal Group (KKB) in Papua.

The research results indicate that the trigerring events of non-international armed conflict can stem from various factors, including economic crises, the presence of crises or scarcity of natural resources, crises related to a country’s geographical conditions, decreased social cohesion within civil society, and crises associated with technological advancements.

The research ultimately revisits the authoritative requirements found in Article 3 of The Geneva Convention 1949, Additional Protocol II 1977, and supplementary explanations present in various decisions of international court such as the intenational Tribunal for the Former Yugoslavia and the International Criminal Court.

In addition, this research highlights the implementation of Indonesia’s National Law, specifically the application of Contitutional Law during wartime emergencies. It also touches upon aspects of Human Rights in response to the ratification of the Internasional Convenant on Civil and Political Rights (ICCPR) and The International Convenant Economic, Social, and Cultural Rights (ICESCR) in 1966.
