Research Summary :
This research elaborates on the potential use of theory of Harm in vertical integration agreements carried out by several integrated companies. Assessing vertically integrated companies is a complex issue that requires challenging identification, especially when measuring the harm to society resulting from vertical integration agreements. Vertically integrated agreements in the production of good/services directly or indirectly, which result in unhealthy business competition and harm to society, can be seen from two (2) aspects. Firstly, the motive aspect, meaning the parties involved in the agreement are integrated companies, involving two or more complementary companies. Secondly, the impact aspect, meaning that the agreement can harm competition. In measuring the loss to consumers/society related to the prohibition of vertical integration agreements, the Indonesian Competition Commision (KPPU) can utilize the theory of Harm, as Article 14 Law No. 5/1999 explicitly requires proving the element of harm to society.
