Research Summary
This research discusses the factors causing the hindrance in implementing PTUN (Administrative Court) decisions and proposes solutions to overcome these obstacles. The research aims to identify the factors causing the hindrance in implementing PTUN decisions and formulate solutions to address these hindrances. The study employs a doctrinal method, emphasizing the use of secondary data from primary legal sources, particularly regulations related to the substantive and procedural aspects of the Administrative Judiciary. Secondary legal sources in the form of reference books and relevant research on the study’s theme are also utilized. In specific, historical and social themes will be explored to examine the social factors influencing law formation. Tertiary legal sources are also used as data retrieval tools. The collected and selected data are analyzed using a qualitative method with a regulatory and conceptual approach. The entire analysis results will be presented descriptively. The research findings indicate that the obstacles in executing PTUN decisions are due to procedural laws that do not guarantee the implementation mechanism of decisions and decisions that fail to consider the ecosystem of administrative law and political administrative aspects. In cases where demands exist to issue new decisions, take action, or revise decisions by issuing new decisions, an ex nunc assessment and the PTUN decision implementation institution are required.
